Lawsuit between Laszlo Sepsi and FC Timișoara, settled only upon contract termination and discharge of back payments

„Labor lawsuit between football player Laszlo Sepsi and FC Timișoara will be settled upon termination of the contract with the group and catching up on his unpaid financial rights from the club”, declared lawyer Tudor Chiuariu for MEDIAFAX agency, on Tuesday.
FC Timișoara Football Club was compelled by the Commission on Settlement of Disputes (part of the Professional Football League) to pay defender Laszlo Sepsi the sum of 37,000 euros in five days from notification, informed sources from the PFL, on Tuesday.
If, within five days from the decision of the Commission on Settlement of Disputes, the sum of money is not paid to player Sepsi Laszlo, his contract with FC Timişoara will be terminated, thus making him free of contract.
The Commission’s decision appears after player Laszlo Sepsi addressed the matter to the Labor Court, requesting termination of the contract, since the group had not fulfilled its financial obligations as agreed in the contract, procedure representing a first in the world of football.
On June 1st, Chiuariu & Associates law firm announced that it addresses the case Sepsi against FC Timisoara to the Labor Court for termination of agreement between parties, after the Commission unreasonably refused to make a decision.
Filing the case before the Labor Court came after the Commission has refused to issue a decision in this case, ignoring the conditions under which it was scheduled for 3rd May 2011.
Last year, Mr. Laszlo Sepsi filed a complaint at CSD, demanding that payments of his financial rights be made.
„What occurred before the Commission for the Settlement of Disputes is beyond anything one could imagine and clearly shows that the activity of this organism needs to be reconsidered. On one hand, it is a simple dispute, where the Club refuses to pay his player, so the contract is to be terminated. On the other hand, we have the Commission, that simply refuses to issue a decision in this matter”, stated Mr. Tudor Chiuariu, lawyer, on June 1st.
In his opinion, „by using this unique and peculiar way of relating to the dispute, the Commission denies Mr. Sepsi’s right of access to court and infringes his right to work, including the right to terminate the contract or to conclude a new one. Therefore, we have decided to address this matter to the Labor Court, requesting the termination of the contract and also the amount consisting in unpaid salaries owed by the Club”, Chiuariu also declared.
The vice-champion, FC Timișoara, has not received the license for the season 2011/2012 of Premier League, declared the Chairman of the Appeal Commission of the National Club Licensing System, Mihai Alexandru Micu on May 30th.
FC Timișoara has not received the license for having public debts – to the state budget and also debts to the club Benfica Lisabona from the transfer of defender Laszlo Sepsi. In a televised statement, FC Timișoara president, Marian Iancu, claimed that his group has no debt to Benfica.
